RESOWI'lON 76-66 <br />• <br />WHEREAS, L. RAY CUNNINGIUIM and FRANCES S. CUNNINGHAM, his wife, did <br />petition the Board of County Commissioners of Indian River County, requesting <br />said Board to adopt- a Resolution to vacate, abandon, discontinue and close <br />certain public streets and roads as hereinafter described; and <br />WHEREAS, a public hearing was duly held by said Board on September 22, <br />1976 , pursuant to Notice thereof duly published in the Vero <br />• <br />Beach Press Journal, a newspaper of general circulation in Indian River <br />County, which said publication was had two weeks prior to the public hearing <br />as required by law; and <br />WHEREAS, the Board of County Commissioners has duly considered the <br />same; <br />NOW,THEREFORE, BE IT RESOLVED that this Board does find and determine <br />the following: <br />3 1. That this Board has published a Notice of the hearing on the <br />petition of L. RAY CUNNINGHAM and FRANCES S. CUNNINGHAM, his wife, one time <br />in the Vero Beach Press Journal, a newspaper of general circulation in Indian <br />River County, Florida, said publication being published at least two weeks <br />prior to the time stated thereon for such public hearing. <br />2. That the land hereinbelow described is not a part of the public <br />road and street required by the State of Florida, by the Federal Government <br />as part of the State or Federal Highway system and said portion of the right- <br />of-way as described hereinbelow is not located within the corporate limits of <br />any municipality and is located in Indian River County, Florida; the following <br />described land is not needed for street, road, highway or other public purposes <br />by Indian River County. <br />BE IT FUR'PIiER RESOLVED that the Board of County Commissioners of <br />Indian River County for and on behalf of Indian River County, Florida, does <br />hereby renounce and disclaim any right, title or interest in and to the <br />following described public street or road, to -wit: <br />All that part of 27th Street lying East of a straight <br />line, the Northern point of which is the Northwest <br />corner of lot 1, Block A, and running thence South <br />to a point which is the Southwest corner of lot 6, <br />Block B; all according to plat of Dodgertown Subdivi- <br />sion, recorded in Plat Book. 3 page 99 public records <br />of Indian River County Florida <br />SUBJECT TO a 5 foot public utility easement along <br />the east boundary of that part of 27th Street as <br />described above; and <br />Smith, Heath & Smith, Attorneys At Law, P. 0. Box 1030, Vero Beach, Florida 32960 <br />
