KOOK 97 P.�1.281 <br />Relevant to the lawsuit, Commissioner Macht asked if the case <br />could be tried on the basis that the loss of sand was not an <br />isolated incident, but on-going, and that at least two studies <br />indicated that 70% of the littoral drift sand is either swept out <br />to sea or into the inlet, thus starving our beaches. <br />County Attorney Vitunac pointed out that the District's <br />position is that, according to the Supreme Court case which they <br />furnished him, jurisdiction is no longer in Circuit Court for that <br />type of suit. <br />Commissioner Macht pointed out that if the beaches are <br />replenished, you have, in effect, created a sacrificial beach with <br />a sacrificial source of sand that would, sooner or later, benefit <br />the entire coast. He indicated his agreement to move forward <br />toward agreement with the SITD to move sand to the south inlet <br />beaches. <br />Chairman Adams indicated that the concern, at this point, was <br />to try to restore the dune line which is being lost.
