Board of County Commissioners Meeting Minutes - Final October 18, 2022 <br />County Attorney Dylan Reingold referred to staff's memo dated October 5, <br />2022, as he recapped the Liberty Park Community Development District (CDD) <br />Petition submitted to the County. County staff and the County Attorney's office <br />believed the submitted Petition satisfied the criteria contained in Florida Statute <br />190.005, as well as in the County's recently -adopted CDD guidelines. Attorney <br />Reingold read the recommendation to approve the establishment of a CDD to <br />fund Liberty Park's development, a multi -use project spanning 502.47 acres. <br />Commissioner Laura Moss raised concerns regarding the comprehensiveness of <br />the traffic impact study which was completed in 2008. Community Development <br />Director Phil Matson informed the traffic study went through a robust concurrency <br />process which considered all 913 planned homes. Director Matson and Attorney <br />Reingold reiterated this hearing was intended to approve the CDD funding <br />mechanism only, noting the developer had the right to move forward with Liberty <br />Park as previously approved regardless of CDD approval. <br />Further discussion was had between Commissioner Moss, Director Matson, and <br />County Administrator Jason Brown regarding the development process. <br />Commissioner Susan Adams provided clarification regarding the safeguards and <br />concerns which had been addressed in 2008. She concluded that this Petition <br />checked all the required boxes for CDD establishment and requested to focus on <br />the CDD funding mechanism so the project could move forward. <br />The Chairman opened the floor for public discussion. <br />Ed Dodd, Sebastian City Council (the City), referenced a letter the City sent to <br />the county questioning whether the CDD or the county would fund improvements <br />to the intersection of Schumann Drive and Barber Street. Chairman O'Bryan <br />recommended having the City send a letter to the MPO requesting this issue <br />remain on the front burner. <br />Andrew Kennedy, Proctor Kennedy Properties, utilized a PowerPoint <br />presentation to detail the approved Liberty Park development and the planned <br />infrastructure. It also outlined CDD reporting requirements, establishment criteria, <br />and the benefits and protections for the County. <br />Attorney Jonathan Johnson, Kutak Rock LLP, presented the benefits and limits of <br />a CDD -funded development versus a privately funded one. <br />Chairman O'Bryan questioned if the $76 million of infrastructure improvements <br />were to be funded entirely through the CDD.
