Extending timeframes for certain incidental to construction <br />mining operations. <br />Staff's analysis of each amendment section follows. It should be <br />noted that, with the exception of sections 18 and 19 of Ordinance <br />2 (see pp. 8-10 of this report), there are no conflicts between the <br />amendments proposed by staff and recommendations from the Planning <br />and Zoning Commission and PSAC. The differing recommendations on <br />amendments 18 and 19 are detailed in the analysis section of this . <br />report. <br />•ORDINANCE 1 (see attachment #11 <br />Section 1. Allowing cemeteries as a special exception use in <br />residential areas. <br />The current LDRs allow stand alone cemeteries in the agricultural <br />districts (A-1, A-2, A-3) only, as a special exception use. <br />Cemeteries developed as part of a place of worship are allowed as <br />accessory uses in all districts where places of worship are <br />allowed. <br />In Indian River County, as well as other east coast counties, <br />cemeteries are almost always located on a coastal sand ridge where <br />the water table is significantly below ground level. Thus,'. <br />cemetery locations in the county are already limited by natural <br />conditions. Furthermore, significant portions of the coastal sand <br />ridge that could potentially be developed as a cemetery are zoned <br />residential. <br />'Staff's local government survey indicates that Brevard, Manatee, <br />Martin, Palm Beach, St. Lucie, Sarasota, and Volusia counties allow <br />stand alone cemeteries in residential districts or, in the case of <br />St. Lucie County, allow cemeteries in an institutional district <br />that is usually located in residentially designated areas. Also, <br />it should be noted that all of the jurisdictions surveyed require <br />.special exception or conditional use approval for cemeteries in <br />residential districts and residentially designated areas. <br />To ensure compatible siting and design of cemeteries, the county <br />has existing special land use criteria that require the following: <br />• A 100' setback between burial areas and abutting residential <br />property. <br />• A 50' setback between burial areas and abutting non- <br />residential property. <br />• A Type "C" buffer between burial sites and residentially <br />designated property, and a Type "D" buffer between burial <br />sites and non -residentially designated property. <br />• A demonstration from the applicant that the cemetery will <br />comply with state regulations. <br />Staff's analysis of these existing criteria is that some <br />clarifications and additions are needed, as follows: <br />1. A clarification that the 100' setback from burial areas to <br />abutting residential property and the 50' setback between <br />burial areas and abutting non-residential property apply to <br />buildings such as mausoleums and columbariums.
