0 <br />RESOLUTION NO. 77- 115 <br />WHEREAS, Indian River County is interested in expanding <br />its parks and recreational land holdings; and <br />® WHEREAS, the CIBA-GEIGY CORPORATION has indicated a <br />willingness to convey certain lands described as: <br />I'I The Northwest one-quarter of the Southwest one-quarter, <br />less the West 40 feet for road right of way purposes, <br />Section 4, Township 32 South, Range 39 East; said lands <br />lying and being within Indian River County, Florida <br />and <br />WHEREAS, the Board of County Commissioners of Indian River <br />County, Florida is willing to accept a conveyance of the <br />above described lands under the condition that the lands <br />remain in a natural state, that they be used for park and <br />recreational purposes, and that the conveying document contains <br />a reverter clause effectuating a reverter of the property to <br />the CIDA-GEIGY CORPORATION in the event the lands were not used <br />for park and recreational purposes; and <br />• WHEREAS, Indian River County, in the future, may have a <br />need to establish well fields on the property and CIBA-GEIGY <br />CORPORATIOI4 recognizes that the establistunent of a well field <br />and distribution lines would not be a violation of the above - <br />stated reverter clause; <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, That in the <br />event the CIBA-GEIGY CORPORATION were willing to transfer the <br />Northwest one-quarter of the Southwest one-quarter <br />less the West 40 feet for road right of wav purposes, <br />Section 4, Township 32 South, Range 39 East; said lands <br />lying and being in Indian River County, Florida <br />that the Board would accept said conveyance, subject to the <br />restrictions as established in the Whereas Clauses above. <br />This Resolution shall become effective as of the 16th <br />day of November, 1977. <br />BOARD OF COUNTY COMI'9ISSIONERS <br />OF IINNDIAN RIVER COUNTY, FLORIDA <br />ATTEST:r� By I� ��! <br />WilTiari C. _T;oc� e, Jr., C tairmzn <br />C erl� <br />
