Lieske, Director of Utilities <br />Prepared By: Cindy Corrente, Utility Finance Manager <br />Subject: Public Hearing to Consider a Resolution Electing to Use the Uniform Method for the Levy, <br />Collection and Enforcement of Non -Ad Valorem Assessments for the North County Water and <br />Sewer Project — Phase 2 <br />On December 6, 2022, the Board of County Commissioners (BCC) announced that they would hold a Public <br />Hearing on Tuesday, December 20, 2022, at 9:05 am, or as soon thereafter as the matter may be heard, <br />to consider adoption of a resolution electing to use the uniform method for the levy, collection, and <br />enforcement of non -ad valorem assessments, pursuant to Florida Statute §197.3632 to recover the costs <br />of the water portion of the North County Water and Sewer Project — Phase 2. The assessment includes <br />161 homes within the six parcels identified in the attached resolution. <br />As part of the process under section 197.3632, Florida Statutes, the BCC will conduct two public hearings. <br />At this first public hearing, the BCC will consider adopting the attached resolution in which the BCC intends <br />to use the uniform method of collecting the non -ad valorem assessments found in Florida Statute <br />§197.3632. Per statute, notice of the public hearing has been advertised for the past four consecutive <br />weeks. If the resolution is approved, staff will send a first-class letter and a copy of the resolution to each <br />property owner in the assessment area, advising them of the second public hearing and providing them <br />with a copy of the proposed ordinance. <br />Additionally, the BCC will need to enter into an agreement with the Tax Collector and Property Appraiser <br />reimbursing the Constitutional Officers for the costs incurred in the collection of the assessment.
