9. Non -Waiver of District Regulatory Powers. Nothing contained in this Agreement <br />shall be construed as a waiver of or contract with respect to the regulatory and permitting <br />authority of the District as it now or hereafter exists under applicable laws, rules and <br />regulations. <br />10. Non -Waiver of Sovereign Immunity. Nothing contained in this Agreement or in any <br />instrument executed pursuant to the terms of this Agreement shall be construed as a <br />waiver or attempted waiver by the District of its sovereign immunity under the constitution <br />and the laws of the State of Florida. <br />IN WITNESS WHEREOF, the undersigned have executed this Agreement as of <br />the date first set forth below. <br />ATTEST: Jeffrey R.
