Keat ng, AICP <br />Community Develop nt Djactor <br />/J•/3. <br />FROM: Stan Boling, AICP <br />Planning Director <br />DATE: February 20, 1996 <br />SUBJECT: Second Hearing for Ordinances Amending the Land <br />Development Regulations (LDRs) <br />It is requested that the data herein presented be given formal <br />consideration by the Board of County Commissioners at its regular <br />meeting of February 27, 1996. <br />BACKGROUND: <br />At its special meeting of February 13, 1996, the Board of County <br />Commissioners reviewed and considered two draft ordinances <br />("Ordinance 1" and "Ordinance 211) containing various proposed LDR <br />amendments. At that time, the Board directed staff to change only <br />two sections of Ordinance 2. Both of those sections related to the <br />parking of commercial vehicles in residential areas (see attachment <br />#1). The Board also indicated that it intended to consider final' <br />adoption of the ordinances at a public hearing scheduled for 9:05 <br />a.m. on February 27, 1996. <br />Staff has revised proposed Ordinance 2 based.uponthe direction <br />given -by the Board. The Board is now to consider final action on <br />both proposed ordinances (see attachment #2). <br />ANALYSIS: <br />At the February 13th meeting, staff presented its recommendation to <br />prohibit specific types of commercial vehicles from being parked <br />outside of enclosed structures in residential neighborhoods. The <br />Board, after considerable discussion, opted not to follow the <br />recommendation from staff or the recommendation from the Planning <br />and Zoning Commission but directed staff to follow the PSAC's <br />recommendation. That recommendation was to allow all commercial <br />vehicles with a rated capacity of 1 (one) ton or less to be parked <br />in residential areas. Such a change will loosen existing <br />restrictions which currently allow only commercial vehicles with a <br />rated capacity of 3/4 ton or less to be parked in residential <br />areas. The result of the proposed change will allow more "box <br />vans and other types of commercial vehicles to be parked in <br />residential areas. Also, such a change will allow Mr. Manuel <br />Silva, who has now addressed the Board twice on this issue, to park <br />his 1 ton rated capacity box van outside of an enclosure, in his <br />driveway at his residence. <br />Staff has revised sections 18 and 19 of proposed Ordinance 2, based <br />upon the Board's direction. All other sections of both ordinances <br />remain unchanged. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners adopt <br />proposed Ordinance 1 and prdinanca 2. <br />Planning Director Stan Boling stated that no changes have been <br />made to the proposed Ordinance 1 as directed by the Board at the <br />February 13, 1996 hearing. <br />The Chairman opened the -public hearing and asked- if anyone <br />wished to be heard in this matter. <br />10 <br />FEBRUARY 27, 1996 <br />�J <br />
