23034 <br />RESOLUTION NO. 79--58 <br />f'"VIB and lof County Commissioners of. Indian River County, <br />Florida, resolve: <br />1. That a petition has been filed by G. FRANKLIN DALES, <br />D. PADDOCK and THE FLORIDA FIRST NATIONAL BANK AT VERO BEACH, as <br />Ancillary Administrator, C.T.A., of the Estate of Gerald L. Dales, <br />deceased, with this Board requesting this Board to vacate a portion <br />of the Plat of Enos, which Plat was recorded in the Public Records of <br />Brevard County, Florida, on June 27, 1889, and recorded in the Public <br />Records of St. Lucie County, Florida, in Plat Book 2, Page 11, on <br />June 16, 1913, and to renounce and disclaim any interest of the County <br />and the Public in and to the streets, roads, and highways shown on <br />said Plat within the boundaries of the following described property: <br />Strip of land 15 feet wide off the North side of <br />Government Lots 1 and 2 of Section 35 and Govern- <br />ment Lots 1 and 2 of Section 36, all in Township <br />31 South, Range 39 East, Indian River County, <br />Florida, being a strip of land running from the <br />Indian River to the Atlantic Ocean. <br />One Acre in the Northeast corner of Government <br />Lot 1, Section 36, Township 31 South, Range 39 <br />East, Indian River County, Florida, described <br />as: Begin on the bank or bluff of the Atlantic <br />Ocean on the North line of said Government Lot 1; <br />thence run West 209 feet; thence South 209 feet; <br />thence East 209 feet to the bank or bluff on the <br />Atlantic Ocean; thence run northerly along said <br />bank or bluff to the Point of. Beginning. And <br />all that property lying East of the above de- <br />scribed property running to the High Water Line <br />of the Atlantic Ocean. <br />2. That at a hearing held on June 6, 1979, this Board deter- <br />mined that the Petitioners had complied with Florida Statute Chapter <br />177 by publishing notice of their intent to apply for a vacation of <br />said portion of said Plat of Enos as will more fully appear by Proof <br />of Publication filed in the minutes of said meeting. The Board <br />further determined that the persons making application for said vaca- <br />tion are the owners in fee simple to the above described property <br />and that the vacation of said portion of said Plat will not affect th <br />ownership or right of convenient access of persons owning other parce <br />located within the bo-rndaiies of the Enos Plat.
