Fr- -1 <br />BOOK 97 m L 461 <br />Elmer's <br />Trading Post was cited <br />for <br />violating the occupational <br />license <br />ordinance because it had <br />10 <br />stalls rented to persons <br />holding <br />a "garage sale" at a rented <br />stall. <br />The Trading Post in its <br />attached <br />letter questions whether this <br />type <br />of sale should be subject to <br />the occupational <br />license tax. As an alternative <br />they suggest as follows: <br />1. Annual purchase of an Occupational License to cover the <br />Market. <br />2. Purchase of 10 additional licenses at a cost of $400.00 <br />annually, to cover itinerant dealers. <br />3. A diligent check to the regular dealers to verify they <br />hold a valid current license. <br />In addition to the above, we would be willing to keep a <br />record of households so 'that they do not exceed the allowable <br />2 time a year garage sale. <br />The above procedure would remove a compliance problem with little, if <br />any, impact on the overall license tax program because as Mr. Cusson <br />states "Elmer's Trading Post is the only Open Air Flea Market licensed <br />in Indian River County and will remain so since we have been <br />Grandfathered in" assuming this is so, we have a one -of -a -kind <br />situation. To remove this problem a minor amendment to the ordinance <br />would be necessary. <br />Commissioner Eggert wondered how it could be regulated, <br />because, when previously discussed, it was felt that the flea <br />market operator should have enough licenses to cover all vendors <br />and could increase rentals enough to cover costs. <br />Attorney O'Brien advised that the concept of householders <br />conducting their "garage sale" at the flea market was never really <br />considered. <br />Commissioner Bird felt each seller should be covered by a <br />license. <br />John Cusson, one of three investors/owners of the property at <br />Elmer's Flea Market, reviewed his letter of February 19, 1996: <br />»liner's Trading Post, inc. <br />945 U.S. 1 <br />Vero Beach Fi <br />3�OGR <br />Att f amen Chandler <br />Adudnistmtor Indian River County Feb. 19,1996 <br />25th Street <br />Vero Ada, F1.32960 <br />Dear -Mr Chandler; <br />As one of the owners of Elmees Trading Post Inc., located on US#1 at Oslo Rd., I am respectfully requesting a <br />varitance to the Occupational Uccusing Ordinance #95-15.
