RESOLUTION NO. 79- 67 <br />The Board of County Commissioners of Indian River <br />County, Florida, resolve: <br />1. That a petition has been filed by ROBERT W. <br />BRADFORD, as Personal Representative of the Estate of HILDA <br />B. WASON, deceased, by and through his undersigned attorney, <br />with this Board requesting this Board to vacate a portion of <br />the Plat of Enos, which Plat was recorded in the Public Records <br />of Brevard County, Florida, on June 27, 1889, and recorded in <br />the Public Records of St. Lucie County, Florida, in Plat Book <br />2, Page 11, on July 16, 1913, said land now lying and being <br />in Indian River County, Florida, and to renounce and disclaim <br />any interest of the County and the Public in and to the streets, <br />roads, and highways shown on said Plat within the boundaries <br />of the following described property: <br />All of Government Lot 1, Section 36, Township 31 <br />South, Range 39 East. <br />EXCEPT one acre in the Northwest corner, thereof <br />described as follows: Begin on the bank of bluff <br />of the Atlantic Ocean on the north line of said <br />Government Lot 1, thence run West 209 feet; thence <br />South 209 feet; thence East 209 feet to the bank <br />or bluff of the Atlantic Ocean; thence run North- <br />erly along said bank or bluff to the point of <br />beginning; , <br />ALSO EXCEPT the North 15 feet of said Government <br />Lot 1. <br />2. That at a hearing held on August 8, 1979, <br />this Board determined that the Petitioners had complied with <br />Florida Statute Chapter 177 by publishing notice of their <br />intent to apply for a vacation of said portion of said Plat <br />of Enos as will more fully appear by Proof of Publication <br />filed in the minutes of said meeting. The Board further <br />determined that the persons making application for said vaca- <br />tion are the owners in fee simple to the above described <br />property and that the vacation of said portion of said Plat <br />will not affect the ownership or right of convenient access <br />of persons owning other parcels located within the boundaries <br />of the Enos Plat.
