1-1 <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that the <br />Resolution dated April 5, 1960 between INDIAN RIVER COUNTY, <br />FLORIDA and GENERAL DEVELOPMENT UTILITIES, INC., as subsequently <br />amended by Resolution No. 77-95, is hereby amended as to <br />Section 14 of the original Resolution as amended,to read <br />as follows: <br />SECTION 14 <br />The rates charged by the Company for its service hereunder <br />shall be fair and reasonable and designed to meet all necessary costs <br />of the service, including a fair rate of return on the net valuation <br />of its properties devoted thereto under efficient and economical <br />management. The Company agrees that it shall be subject to all <br />authority now or hereafter possessed by the County or any other <br />regulatory body having competent jurisdiction to fix just, reasonable <br />and compensatory rates. When this franchise takes effect, the Company <br />shall have authority to charge and collect not to exceed the following <br />schedule of rates, which shall remain effective until changed or <br />modified as herein provided, to -wit: <br />WATER <br />RESIDENTIAL SERVICE. RATE SCHEDULE <br />Availability - Available throughout the area served by the Company. <br />Applicability - For water service for all purposes in private <br />residences and individually -metered apartment units. <br />Limitations - Subject to all of the Rules and Regulations of this <br />Tariff. <br />Monthly Rates <br />First 3,000 Gallons $5.00 Minimum per month <br />Over 3,000 Gallons $1.00 per 1,000 Gallons <br />Minimum Charge - $5.00 Per month. <br />Terms of Payment - Bills are due and payable when rendered and become <br />delinquent if not paid within twenty (20) days, and may, after five <br />(5) days writtcn notice, be discontinued. <br />Billing - Bills shall be rendered monthly and the meter reading <br />dates shall coincide as near as practically possible, and bills <br />rendered as soon as possible thereafter. Bills rendered for less <br />than fifty per cent (50%) of the normal billing period will be <br />billed in accordance with Rule 25-10.97 (2), Florida Administrative <br />Code: "Whenever, for any reason, the period of service for which a <br />bill is rendered is less than fifty percent (50%) of the normal <br />billing period, the charges applicable to such service, including <br />minimum charges, shall be prorated in the proportion that the actual <br />number of service days bears to a thirty (30) day month; except that: <br />
