TRAFFIC SHIM, A003UNT <br />'MIS AGRIiI:WNT, made and entered into this day of <br />19 , by and between the State of F1orid;a Department <br />of Transportation, an agency of the State of Florida, herein called the <br />"Department," and INDIAN RIVER COUNTY , Florida, herein called the "Public Body," <br />WITNUSSFTi l : <br />MUMEAS the construction, maintenance, and operation of a traffic s i lma i, Or <br />signals, are necessary for safe and efficient highway tnuisportat ion at Certain <br />locations along the State Highway System; and <br />IWIREAS the Department proposes that certain existing and proposed traffic <br />signals and signal systems are to be maintained and operated along the State <br />highway System and shall maintain an approved list of such signals and systems; and <br />AIDEREAS the Public Body, by Resolution attached hereto and made a part hereof, <br />and the Department, by this agreement, have determined that it is in the public <br />interest for the Public Body to maintain and operate signal installations along <br />the State Highway System; <br />NOW, 714U iFORE, in consideration of the premises and the mutual covenants <br />contained herein to be undertaken by the respective parties hereto, the parties <br />mutually agree and covenant as follows: <br />1. When the District Traffic Operations Engineer of the Department has served <br />a request order on the Public Body, and the designated officer of the Public Body <br />named in the Resolution to accompany this agreement has favorably acknowledged <br />the order, the Public Body shall undertake the maintenance and operation of such <br />signalized intersections and interconnected systems of signalized intersections <br />as are included in the order and in accord with the mutual covenants contained <br />in this agreement. <br />2. The traffic signal or signals, as described in the approved and acknowledged <br />order, will he so desilmed that the signal operation is as energy-efficient as <br />possible, and, in consideration of a design review by the public MAY, and, when <br />installation of the traffic signal(s) is to be performed by either the public liody <br />or under the supervision of the Department, the construction ;uid/or installation <br />shall not endanger travel along the roadways involved and all operations shall he <br />conducted in accord with the Manual on Traffic Controls and Safe Practices (]art VI! <br />as published by the D>eparMent. <br />
