RESOLUTION NO. 80- 92 <br />WHEREAS, on the 11th day of January, 1973, the CITY OF VERO <br />BEACH and INDIAN RIVER COUNTY entered into an Agreement affecting <br />Utilities, both water and sewer, within Indian River County; and <br />WHEREAS, on the 17th day of April, 1975, the CITY OF VERO <br />BEACH, INDIAN RIVER COUNTY and the INDIAN RIVER COUNTY HOSPITAL <br />DISTRICT entered into a Tripartite Agreement delineating the <br />servicing of water and sewer utilities to the eighty (80) acre <br />HOSPITAL site; and <br />WHEREAS, the April 17, 1975 Agreement contained an Addendum <br />which states: <br />"That the water and/or sewer service provided by <br />the CITY OF VERO BEACH to THE INDIAN RIVER COUNTY <br />HOSPITAL DISTRICT shall be considered part of the <br />capacity allocated to INDIAN RIVER COUNTY at the City's <br />water and sewage treatment plants, as provided and set <br />forth in Paragraph 5 of Annex I, of the January 11, 1973 <br />Tripartite Agreement." <br />and <br />WHEREAS, there existed as of April 17, 1975 an engineering <br />report advising that the ultimate sewer needs of the HOSPITAL would <br />be 500,000 gallons per day; and <br />WHEREAS, history has shown the sewer requirements of the <br />INDIAN RIVER COUNTY HOSPITAL DISTRICT will be substantially less <br />than 500,000 gallons per day; and <br />WHEREAS, the INDIAN RIVER COUNTY HOSPITAL DISTRICT has <br />officially indicated to INDIAN RIVER COUNTY that its ultimate <br />sewer needs will not exceed 400,000 gallons per day; and <br />WHEREAS, the CITY OF VERO BEACH has requested that INDIAN <br />RIVER COUNTY formally allocate part of the sewer allocation <br />available under the January 11, 1973 Agreement to the INDIAN RIVER <br />COUNTY HOSPITAL DISTRICT; and <br />WHEREAS, the allocation by the COUNTY to the INDIAN RIVER <br />
