ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously (4-0, <br />Commissioner Bird being absent) approved the <br />proposed Work Authorization with Camp Dresser and <br />McKee, Inc., for services in connection with Vista <br />Royale WWTP in the amount of $1,076, as recommended <br />in the Memorandum. <br />WORK AUTHORIZATION IS ON FILE <br />IN THE OFFICE OF THE CLERK TO THE BOARD <br />STORM GROVE ROAD - SCHEDULE DATE TO DETERMINE IF <br />TIEERE IS A PRESENT NEED FOR CONSTRUCTION <br />Assistant County Attorney Terry O'Brien reviewed a Memorandum <br />of March 6, 1996: <br />TO: Board of County Commissioners <br />FROM: Terrence P. O'Brien, Assistant County AttorneyT4, <br />DATE: March 6, 1996 <br />SUBJECT: DETERMINE IF THERE IS A PRESENT NEED FOR THE <br />CONSTRUCTION OF STORM GROVE ROAD <br />Background: <br />A developer's agreement was entered into on October 2, 1985, between <br />Indian River County and Vero Sand Pines, a Florida general <br />partnership, hereinafter "Sand Pines" ( copy attached as Exhibit "All). <br />The agreement had for its purpose the facilitation of the construction of <br />Hawk's Nest Golf Course and at the same time it established, in the <br />view of the office of the County Attorney, legal obligations for the <br />construction of a portion of Storm Grove Road to serve Sand Pines <br />property. A memorandum prepared by the office of the County <br />Attorney on this subject is attached as Exhibit "B". <br />By letter dated August 30, 1994 (copy attached as Exhibit "C") Robert <br />A.' Cairns, Managing Partner of Sand Pines, asked the County to "put <br />into action the construction of Storm Grove Road to Lateral G" to allow <br />him to develop his property. This request was renewed by Mr. Cairns <br />in his letter of April 19, 1995 ( copy attached as Exhibit "D") . <br />If Storm Grove Road is constructed on County right-of-way it will <br />divide Hawk's Nest Golf Course. The attorney for Hawk's Nest is of <br />the opinion that the County is under no legal obligation to construct <br />Storm Grove Road to serve Sand Pines. <br />The Board of County Commissioners at its regular meeting of May 16, <br />1995 considered the matter and heard presentations from Mr. Cairns and <br />119 PUOF 9 5 <br />March 19, 1996 <br />J <br />
