s � � <br />The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. <br />Bruce Barkett, representing the applicant, advised he was <br />present to answer any questions. He felt that staff had done a <br />good job and he hoped the Board would approve the request. <br />It was determined that no one else wished to be heard and the <br />Chairman closed the public hearing. <br />ON MOTION by Commissioner Macht, SECONDED by <br />Commissioner Tippin, the Board unanimously (4-0, <br />Commissioner Bird being absent) adopted Ordinances <br />96-07 and 96-08 to redesignate the subject property <br />to M-1 and rezone the subject property to RM -8, as <br />recommended by staff. <br />ORDINANCE NO. 96-07 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, FLORIDA, AMENDING THE <br />LAND USE ELEMENT OF THE COMPREHENSIVE PLAN BY CHANGING THE <br />LAND USE DESIGNATION FOR #18.4 ACRES LOCATED AT THE SOUTHEAST_ <br />CORNER OF 26TH STREET AND 58TH AVENUE, FROM L-2 TO M-1; AND <br />PROVIDING SEVERABILITY AND EFFECTIVE DATE. <br />WHEREAS,••the Board of County Commissioners adopted the Indian <br />River County Comprehensive Plan on February 13, 1990, and <br />WHEREAS, the county received comprehensive plan amendment <br />applications during its July 1995 amendment submittal window, and <br />WHEREAS, the Local Planning Agency held a public hearing on <br />all comprehensive plan amendment requests on October 12, 1995 after <br />due public notice, and <br />WHEREAS, the Local Planning Agency recommended approval of <br />this comprehensive plan amendment to the Board of County <br />Commissioners, and <br />WHEREAS, The Board of County Commissioners of Indian River <br />County held a Transmittal Public Hearing on November 21, 1995, <br />after advertising pursuant to F.S. 163.3184(15)(b)(1) and (c), and <br />WHEREAS, the Board of County Commissioners approved the <br />transmittal of this comprehensive plan amendment to the Florida <br />Department of Community Affairs for their review and comment, and <br />65 <br />March 19, 1996 <br />
