RESOLUTION NO. 8146 <br />WHEREAS, on May 6, 1981, TREASURE COAST UTILITIES, INC. and <br />D. TRAVIS SALTER filed Civil Action No. 81-8175 in the U. S. <br />District Court for the Southern District against WILLARD W. SIEBERT, ,JR, <br />ALMA LEE LOY, WILLIAM C. WODTKE, R. DON DEESON, PATRICK B. LYONS, <br />A. GROVER FLETCHER, DON C. SCURLOCK, JR., DICK BIRD, ED SCHMUCKER, <br />GEORGE G. COLLINS, JR. and THE COUNTY OF INDIAN RIVER, FLORIDA; and <br />WHEREAS, pursuant to Florida Statutes 111.07, 111.071 and <br />other appropriate author.ty, INDIAN RIVER COUNTY is authorized to <br />provide a defense and to pay judgments or settlements on behalf of <br />the above named persons who are named individually in the above <br />styled litigation. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMIS- <br />SIONERS OF INDIAN RIVER COUNTY, FLORIDA, that, pursuant to the <br />above cited authority, <br />1. INDIAN RIVER COUNTY shall provide legal defense on behalf <br />of each of the above named defendants and pay the costs associated <br />with such defense including appeals. <br />2. INDIAN RIVER COUNTY shall pay any judgments or settlements <br />that may be obtained against the above named individual defendants <br />including damages (all as alleged in the Complaint), costs and <br />attorneys fees. <br />3. Indemnify and hold harmless each of the above named <br />individuals from all damages, costs and attorneys fees arising <br />from the above styled civil action. <br />4.
