RESOLUTION NO. 81-57 <br />RESOLUTION REVOKING INDIAN RIVER COUNTY <br />RESOLUTION 67-37 AND PROHIBITING THE <br />OPERATION OF ALL MOTORIZED VEHICLES UPON <br />ANY PART OF THE PUBLIC BEACHES LOCATED <br />WITHIN INDIAN RIVER COUNTY, FLORIDA, <br />PURSUANT TO THE AUTHORITY OF SPECIAL <br />ACTS CHAPTER 61-2272; PROVIDING FOR <br />PENALTIES FOR VIOLATIONS AND PROVIDING <br />AN EFFECTIVE DATE. <br />WHEREAS, pursuant to the authority of that Special Act <br />applying to Indian River County referred to as Chapter 61-2272, <br />the BOARD OF COUNTY COMMISSIONERS has authority to prohibit the <br />operation of motor vehicles upon public beaches in Indian River <br />County, Florida; and <br />WHEREAS, in order to protect the sand dunes, vegetation <br />growing on the dunes and certain wildlife frequenting the <br />beaches, the BOARD OF COUNTY COMMISSIONERS determines for health <br />and welfare purposes of all citizens of Indian River County that <br />all motorized vehicles except those exempted shall be prohibited <br />from using the public beaches within Indian River County, <br />NOW, THEREFORE, BE IT RESOLVED by the BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that <br />A. Indian River County Resolution 67-37 is hereby revoked, <br />vacated and abolished. <br />B. From the date of this Resolution no motor vehicles <br />except those exempted shall. be operated upon any part of the <br />public beaches located within Indian River County, Florida. <br />C. This Resolution is adopted pursuant to the authority of <br />Special Acts, Chapter 61-2272, and the definitions as set forth <br />in said Special Act shall apply. <br />D. It shall be unlawful for any person to operate a motor <br />vehicle except those exempted upon the public beaches in Indian <br />River County, Florida, or any part thereof, in violation of any <br />of the terms, conditions, restrictions and limitations as set <br />forth in this Resolution. <br />E. Emergency motorized vehicles, law enforcement motorized <br />vehicles, and motorized vehicles used for maintenance or scientific <br />purposes approved by the County Administrator in writing shall be <br />exempted from this Resolution. <br />
