• <br />AA <br />RESOLUTION No. 81-61 <br />BOARD OF COUNTY COMMISSIONERS <br />INDIAN RIVER COUNTY, FLORIDA <br />WHEREAS, the Sheriff of Indian River County has requested that the <br />Board of County Commissioners establish a special Law Enforcement Trust <br />Fund pursuant to Florida Statute 943.44(3)(a) of the "Florida Contraband <br />Forfeiture Act"; and, <br />WHEREAS, these funds may be expended only upon appropriation to the <br />Sheriff's Office by the Board of County Commissioners, to: <br />(1) Defray the costs of protracted or complex <br />investigations. <br />(2) Provide additional technical equipment or <br />expertise. <br />(3) Provide matching funds to obtain Federal <br />grants. <br />Or, <br />(4) For such other law enforcement purposes as the <br />Board of County Commissioners deems appropriate; <br />and, <br />WHEREAS, the funds of the special Law Enforcement Trust Fund shall not <br />be considered a source of revenue to meet normal operating needs; and, <br />WHEREAS, the Sheriff shall provide to the Board of County Commissioners <br />a quarterly report which shall specify for such quarterly period, the type and <br />approximate value of property received and the amount of any proceeds received; <br />and, <br />WHEREAS, neither the Sheriff nor the Board of County Commissioners shall <br />anticipate future forfeitures or proceeds therefrom in the adoption and <br />approval of the budget for the operation of the Sheriff's Office. <br />BE IT THEREFORE RESOLVED THAT THE Board of County Commissioners of <br />Indian River County does hereby establish a special Law Enforcement Trust <br />Fund for the above described reasons. <br />PASSED AND DULY ADOPTED in regular session by the Board of County <br />Commissioners of Indian River County, Florida this 2nd day of <br />September '19 81 <br />ATTEST: <br />,Clerk ,Chairman <br />Indian River County, Florida Indian River County Board of County <br />Commissioners. <br />
