/. <br />RLSOLUTION NO. 81-1.08 <br />RESOLUTION OF THE BOARD <br />OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA <br />REQUESTING THE LEGISLATURE OF THE STATE OF FLORIDA <br />TO CONDUCT A REVIEW OF THE EFFECT OF STATE MA14DATED <br />PROGRAMS ON LOCAL GOVERNMENT FINIANCES. <br />WHEREAS, the Board of County Commissioners of Indian River County has <br />been faced with balancing the need for fundamental governmental services for <br />the citizens of the County against the increased taxes necessary to provide <br />expanded services, and <br />WHEREAS, the balancing of services versus taxes is disrupted when the <br />Legislature mandates the various counties to perform and collect taxes for <br />programs that are not the local government's responsibility, and <br />AIEREAS, when programs are imposed upon local government without providing <br />concurrent sources of non -ad valorem funding, the Legislature circumvents Article <br />7, Section I (A) of the State of Florida Constitution which provides;... no <br />State ad valorem taxes shall be levied upon real estate or tangible personal <br />property..., and <br />WHEREAS, State mandated programs include; Medicaid Programs, Mental Health, <br />Baker, and Myer Act Programs, indigent health care, indigent court costs and <br />Court appointed attorney's fees, medical examiner's fees, the court system <br />expenses, State Attorney and Public Defender Office space requirements and County <br />audit provisions <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF <br />INDIAN RIVER COUNTY, FLORIDA THAT; <br />1. The County Commission requests that the Honorable Robert Graham establish as a <br />priority, in the upcoming Legislative Session, a review of the effects of <br />State mandated programs on local government finances, and <br />2. The County Commission further requests the Legislature to provide a means <br />of funding mandated programs other than ad valorem taxation, and <br />3.
