Im <br />RESOLUTION NO. 82-37 <br />® A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY IN OPPOSITION TO THE PASSAGE <br />OF HOUSE BILL 680, SENATE BILL 579 AND HOUSE <br />BILL 645. <br />® WHEREAS, it is the responsibility of the various counties <br />to plan for and provide necessary urban services to the unincor- <br />porated portions of counties within the State of Florida, and <br />WHEREAS, the planning necessary to accomplish this goal <br />• 0 must be done many years in advance to accommodate the growth <br />pattern now prevalent in southeast Florida, and <br />WHEREAS, Senate Bill 579 House Bill 680 if adopted will <br />frustrate attempts by counties to plan for future orderly growth, <br />and <br />WHEREAS, under current law areas sought to be voluntarily <br />annexed must be contiguous to the municipal limits thereby assuring <br />that annexations will occur in an orderly sequential pattern, and <br />WHEREAS, the proposed bills delete the requirement that <br />the property be contiguous as long as the area is within an annexa- <br />tion reserve area that may be established and defined by municipal <br />ordinance or other legally binding agreement, and <br />WHEREAS, the proposal does not define or limit munici- <br />pality's power to designate any property whatsoever as being within <br />the city's reserve area, and <br />IF these proposals become law, it will allow municipali- <br />ties to annex areas that are not coterminous with the city limits, <br />creating county pockets, enclaves and defeating the current purpose <br />of fostering orderly annexations of unincorporated areas, and <br />WHEREAS, these amendments will impede the County's <br />ability to plan for future development under the local government <br />Comprehensive Planning Act of 1975, and <br />WHEREAS, House Bill 645 is an attempt to weaken the <br />notice required to be published by a municipality to inform inter- <br />ested residents of the city's annexation activities. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />����\ COMMISSIONERS OF INDIAN RIVER COUNTY that; <br />
