BOOK 9tTAGE '707, 7 <br />EXTENSION OF LAND DEVELOPMENT PERAM - TIM LAURELS <br />The Board reviewed the following memo dated 3/15/96: <br />TO: James Chandler <br />County Administrator <br />THROUGH: James W. Davis, P.E. <br />Public Works Director <br />FROM: Roger D. Cain, P.E. <br />County Engineer <br />SUBJECT: Land Development Permit Extension for The Laurels Subdivision <br />Land Development Permit No. 92010057-006 <br />DATE: March 8, 1996 <br />DESCRIPTION AND CONDITIONS <br />The Land Development Permit for the above development has expired and the developer <br />seeks to extend the permit. A letter from the developer is attached for the Board's <br />information. <br />ALTERNATIVES AND ANALYSIS <br />At the present time the Land Development Regulations provide for only an eighteen month <br />land development permit. Staff recommends that an extension be given to the land <br />development permit for The Laurels Subdivision, however, we believe that we are without <br />authority to extend the land development permit at this time to five years as requested by <br />the developer, due to the Land Development Regulation governing the time of such permits. <br />There may be a need to revisit the length of time that land development permits are <br />effective, but at this time it does not appear that the extension of this particular land <br />development permit can be for more than eighteen months. <br />There are a number of reasons to limit the time of a land development permit, obviously <br />a permit should not be good ad infinitum due precisely to the reasons that the developer <br />cites in her letter, that we cannot foresee the future and changes may occur that would <br />obviate the permit originally given. In addition the county has a duty to control and <br />regulate development in the county for the purposes of public health and safety including <br />protection of the environment. There have been instances, as the Board may be aware, <br />where construction of developments has not been completed, the county has been forced <br />to use surety posted for unfinished work to complete projects. It is not in the best interest <br />of the county or its citizens to have projects stand idle for long periods of time where the <br />site may be unsecured, hazards may develop or exist and erosion, drainage and other <br />environmental conditions can be allowed to exist for long periods of time without proper <br />control. <br />Alternative No. 1 - Extend the land development permit for The Laurels Subdivision for <br />another eighteen month period and direct staff to have the PSAC consider an LDR change <br />incorporating a longer land development permit time period. <br />Alternative No. 2 - Do not extend the land development permit for The Laurels Subdivision. <br />RECOMMENDATION & FUNDING <br />Staff recommends Alternative No. 1. No funding is anticipated for this alternative. <br />MOTION WAS MADE by Commissioner Eggert, SECONDED by <br />Commissioner Bird, to approve Alternative No..1 to <br />grant another 18 month extension and direct staff to <br />have the PSAC consider an LDR change incorporating a <br />longer land development permit time period. <br />30 <br />MARCID 26, 1996 <br />
