FLORIDA DF.PAP+^-aN'T OF NATURAL RSSOURC ES <br />DIVISION OF 3EACFiMS AND .SHORES <br />APPLICATION POR FENDS UNDER PROVISIONS OF <br />CHAPTER 161.091, FLORIDA STATUTrs <br />EROSION CONTROL PROGRAM <br />Project Proposal - Part IV: Required Stipulations <br />For an erosion control project to qualify for funding, the project sponsor must <br />provide assurances that the applicant recognizes and agrees that its responsi- <br />hi_ti•ti,ee pertaining to the project are as follows: <br />1. The applicant will to the extent provided by law hold and save the State of <br />Florida, its agencies, officers and employees harmless from any and all <br />liabilities ;hich may result from the construction or opei:ation of this <br />project. <br />2. Select a project engineer on a competitive negotiation basis as outlined in <br />Chapter 287, Florida Statutes. If applicant elects to use a private <br />engineering firm, any engineer used for design of this project either public <br />or private rn:st be registered in the State of Florida. <br />3. Contribute in cash or in-kind service the local share of the project <br />const -ruction cost or study cost and assume full responsibility for all pro- <br />ject costs in excess of the State -Federal cost limitation. <br />4. Provide without cost to the State of Florida all necessary lands, easements <br />and rights-of-way required for the project. <br />S. Assure continued public o•.mership or continued public use of the shore upon <br />which the amount of State participation is based, and its administration for <br />public use during the economic life of the project. <br />6. assure maintenance and repair, and local share of periodic beach nourishment <br />where applicable, during the useful life of the project as required to serve <br />the projects intended purpose. <br />7.
