RESOLUTION NO. 82-78 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, FOR THE ACQUISITION <br />OF A`PORTION OF THE RIGHT-OF-WAY NECESSARY FOR THE <br />CONSTRUCTION OF 14TH STREET TO COUNTY STANDARDS. <br />WHEREAS, the Board of County Commissioners of Indian <br />River County desires to improve 14th Street to County marl road <br />standards thus providing a County maintained means of ingress and <br />egress to the proposed new site for the headquarters of the <br />Council on Aging for Indian River County, and <br />WHEREAS, Town Villas, Inc., a Florida corporation, owns <br />thirty-five (35') feet of the property necessary for the construc- <br />tion of the roadway as well as the abutting property, and <br />WHEREAS, Town Villas, Inc. recognizes that at such time <br />when the corporation requests site plan approval on the abutting <br />property the corporation would have to dedicate and pay for the <br />partial improvement of a portion of 14th Street, and <br />WHEREAS, the corporation desires to dedicate the <br />necessary right-of-way prior to site plan approval, and the County <br />agrees to accept the necessary right-of-way according the follow- <br />ing terms; <br />1. The County presently plans to bring 14th Street to <br />County standards as a marl road and maintain same at no expense to <br />Town Villas, Inc.. <br />2. (a) That the County will pave to County standards <br />14th Street along the full length of the legal description and on <br />the abutting right-of-way at a cost not to exceed fifty (50%) <br />percent of the cost of the construction to be assessed to Town <br />Villas, Inc. property or (b) upon presentation of a site plan for <br />improvement of the property presently owned by Town Villas, Inc. <br />and abutting this right-of-way strip, that the County will either <br />specially assess other property owners or pay out of its own <br />revenues at least fifty (50%) percent of the cost of paving to <br />County standards 14th Street along the right-of-way so dedicated <br />by Town Villas, Inc. thus charging property owned by Town Villas, <br />Inc. no more than fifty (50%) percent of the cost of the <br />improvement. <br />-1- <br />
