RESOLUTION NO. 82- 82 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, TERMINATING THE <br />TREASURE COAST UTILITIES, INC. WATER AND SEWER <br />FRANCHISE AND AUTHORIZING THE IMPOSITION OF <br />STANDARD COUNTY RATES. <br />WHEREAS, Indian River County on February 17, 1960, <br />issued a water and sewer franchise to Southern Gulf Utilities, <br />Tn(-,; ? Florida corporation, Nuisuant to the provisions of Special <br />Acts of Florida Chapter 59-1380, and <br />WHEREAS, through a series of assignments the franchise <br />was assigned to Treasure Coast Utilities, Inc., and <br />WHEREAS, Indian River County has now purchased all the <br />assets of Treasure Coast Utilities, Inc. and has merged the system <br />into the County's water and sewer system, and <br />WHEREAS, the County Commissi n on August 4, 1982, held a <br />duly advertised public hearing to consider the formal termination <br />of the franchise and imposition of standard County rates on cus- <br />tomers within the former franchise area, and <br />WHEREAS, during the public hearing there was no opposi- <br />tion from the public or customers. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that; <br />1. The water and sewer franchise originally issued on <br />February 17, 1960, to Southern Gulf Utilities, Inc. and subse- <br />quently through a series of assignments, assigned to TYeasure <br />Coast Utilities, Inc. is hereby terminated, and <br />2. the Indian River County Utilities Department is <br />authorized to charge water and sewer customers within the former <br />Treasure Coast Utilities franchise territory standard County rates <br />beginning at such time as County provides improved water from a <br />reliable source. <br />The foregoing resolution was offered by Commissioner <br />Wodtke who moved its adoption. The motion was seconded <br />by Commissioner Lyons and, upon being put to a vote, the <br />vote was as follows: <br />
