Evidence that conditions imposed as part of the <br />Conceptual Approval Agreement are satisfied <br />Affidavit that there is no existing or pending violation <br />of -any local, state, regional or federal laws or <br />regulations on. the .project.site <br />Documents of the project plan listed above - aside from Board <br />approval of the purchase agreement and management plan - can be <br />handled administratively, and will be provided to FCT by county <br />staff contingent upon Board approval of the acquisition. <br />•Public Hearing <br />The attached Option Agreement is herein presented to the Board for <br />initial concurrence, in order to submit a project plan to the FCT <br />in time for FCT's meeting on May 12th. <br />In accordance with land acquisition guide (and State) requirements, <br />staff will schedule a separate, advertised public hearing for the <br />Board of County Commissioners to consider exercising the Sebastian <br />Highlands/AGC Option Agreement. That public hearing will <br />tentatively occur at a regular meeting of the Board in mid May. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners approve the <br />Atlantic Gulf Communities/ Sebastian Highlands Scrub purchase <br />contract Option Agreement and the attached management plan. Staff <br />also recommends that the Board authorize staff to submit a Project <br />Plan to the FCT to fulfill requirements of the FCT cost -share <br />Conceptual Approval Agreement. <br />35 <br />April 9, 1996 <br />BOOK 97 PAGE 762 <br />
