61 <br />RESOLUTION NO. 83-54 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA, PROVIDING FOR <br />THE CLOSING, ABANDONMENT AND VACATION OF A <br />25 FOOT WIDE EASEMENT OF ROADWAY LOCATED <br />APPROXIMATELY 100 FEET EAST OF U.S. HIGHWAY <br />NO. 1, ON THE NORTH SIDE OF 9TH STREET, SW <br />(OSLO ROAD). <br />WHEREAS, on April 22, 1983, the County received a duly <br />executed and documented petition from Oslo Square Associates, a <br />Florida General Partnership, of 4740 North State Road 7, Fort <br />Lauderdale, Florida, requesting the County to close, vacate and <br />abandon and disclaim any right, title and interest of the County and <br />the public in and to a 25 foot wide easement of roadway located <br />approximately 100 feet east of U.S. Highway No. 1, on the north side <br />of 9th Street, SW (Oslo Road). <br />WHEREAS, in accordance WITH Florida Statutes S 336.10, <br />notice of a public hearing to consider said petition has been duly <br />published; and <br />WHEREAS, after consideration of the petition, supporting <br />documents, staff investigation and report, and testimony of all <br />those interested and present, the Board finds that said right-of-way <br />is not a state or federal highway, nor located within any <br />municipality, nor is said right-of-way necessary for continuity of <br />the County's street and thoroughfare network, nor access to any <br />given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. All right, title and interest of the County and the <br />public in and to that certain right-of-way described as lying: <br />12 1/2 feet on each side of each boundary of the <br />Northeast 1/4 of the Southwest 1/4 of Section 19, <br />Township 33 South, and Range 40 East and 12 1/2 <br />feet on each side of each boundary of the <br />southeast 1/4 of the Southwest 1/4 of Section 19, <br />Township 33 South, Range 40 East, <br />lying and being in the following described real property: <br />A portion of the Southwest 1/4 of Section 19, <br />Township 33 South, Range 40 East, Indian River <br />County, Florida, lying easterly of the easterly <br />right-of-way of U.S. Highway No. 1, being more <br />particularly described as follows: <br />Commencing at a point of intersection of the South <br />line of the Paul Goodridge property as described <br />in Official Record Book (O.R.B.) 24, Page 363, <br />Public Records of Indian River County, Florida, <br />with the new East right-of-way of U.S. Highway No. <br />1; thence South 12° 05' 58" East (assumed datum) <br />along said right-of-way 115.73 feet; thence South <br />89° 42' 46" East along a line parallel with and <br />1018.8 feet South of (as measured at right angles <br />to) the North line of the Southwest 1/4 of Section <br />19, Township 33 South, Range 40 East, Indian River <br />County, Florida, 187.87 feet to the East line of <br />the property conveyed to Waldo E. Sexton and <br />Elsebeth M. Sexton, his wife, by Warranty Deed <br />dated May 2, 1951, and recorded in Deed Book 67, <br />Page 93, of the Public Records of Indian River <br />
