RESOLUTION NO. 83-62 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA AUTHORIZING EXECUTION <br />OF A LICENSE AGREFMENT WITH FLORIDA EAST COAST <br />RAILWAY GOVERNING THE 4TH STREET GRADE CROSSING. <br />WHEREAS, the County Public Works Department is preparing <br />to open 4th Street (Citrus Road) from its present terminus at Old <br />Dixie Highway through to U. S. Highway #1; and <br />WHEREAS, the 4th Street extension will cross existing <br />Florida East Coast right-of-way and tracks, thereby necessitating <br />an agreement governing use of the FEC right-of-way by the County <br />and setting forth certain responsibilities for placement and <br />maintenance of warning devices, crossing structures, and other <br />features of the crossing; and <br />WHEREAS, it has been determined that the terms of the <br />agreement are reasonable and that eyjcution of this License <br />Agreement is in the interest of the citizens of Indian River <br />County, Florida. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that the foregoing <br />recitals are ratified and that the Chairman and Clerk are <br />authorized to execute and deliver two original copies of the <br />proposed License Agreement attached hereto as Exhibit "A". <br />The foregoing resolution was offered by Commissioner <br />Lyons who moved its adoption. The motion was seconded <br />by Commissioner Bowman and, upon being put to a vote, the <br />vote was as follows: <br />Chairman Richard N. Bird Aye <br />Vice -Chairman Don C.
