RESOLUI'IOO NO. 83-108 <br />BE IT RESOLVED by the Board of County Conmissioners o f I ndian River <br />County, Florida1 <br />SOCTION I <br />This Resolution s ha ll be kno,m and may be cited as the "BAYSIDE <br />tJrILITIFS WASTEWATER SYSTEM FRANCHISE ". <br />SOCTION II <br />DEFINITIOOS <br />For the purpose of this Resolution, the foll0,1ing terms , phrases , <br />words and their derivations shall have the rreaning givei. herein. When <br />not inconsistent with the context, words using the present tense include <br />the future , words in the plural nurrber include the singular and vice <br />versa. The word "shall " is always mandatory. <br />(a ) "County " is Indian River County Utility Services Deparbrent , a <br />political subdivision of the State of Florida. <br />(b) "County Engineer" may be "County Administrator or County <br />Utilities Director". <br />(c ) "Utility" is the Grantee of rights under this franchise, to <br />wit: BAYSIDE tJrILITI.E.S. <br />(d) "Board " is the Board of County Conmissioners . <br />(e ) "Person" is any person , firm, partnership, association, <br />corporation , canpany or organization of any kind. <br />(f ) "Territory" rreans the area located in Indian River County , <br />Florida outside the corporate limits of any municipality as the sarre is <br />rrore particularly defined and described herein . <br />(g) "Irrigation System" shall rrean and include any real estate , <br />attachrrents, fixtures, impounded water, water mains, services , valves , <br />rreters , plant , wells , pipes , tanks , hydrants , pumps , reservoirs , <br />systans , facility or other property , real or personal, used or useful or <br />having the present capacity for f uture use in connection with the <br />collection, obtaining , treatrrent, supplying and distribution of treated <br />~ffluent irrigation water to the public for consumption by residential , <br />business or industry and without limiting the generality of the <br />foregoing, shall embrace all necessary appurtenances and equiprent and <br />1
