do <br />•! <br />RESOLUTION NO. 83- 115 <br />A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS <br />OF INDIAN RIVER COUNTY, FLORIDA DESIGNATING CERTAIN <br />PROPERTY AS LYING WITHIN THE I-95 CR512 COMMERCIAL/ <br />INDUSTRIAL NODE. <br />WHEREAS, the Board of County Commissioners of Indian <br />River County, after notice and public hearing, adopted an <br />ordinance amending the County's Comprehensive Plan to redesignate <br />the commercial node at the intersection of I-95 and CR512 as a <br />175 -acre commercial/industrial node; and <br />WHEREAS, Helene Holding Co., as Agent for D.S.C. <br />Enterprises of Newark, Inc., the owner of a 100 -acre parcel near <br />the intersection, has requested that the County make a formal <br />determination as to whether their property lies within said node, <br />within the meaning and intent of the County's Comprehensive Plan; <br />and <br />WHEREAS, the County's Planning and Zoning Commission, <br />after notice and public hearing, has recommended that the County <br />Commission favorably consider the requested designation; and <br />WHEREAS, the Board of County Commissioners has conducted <br />a public hearing, after due notice, on the issue of whether or not <br />the aforementioned property, which is more particularly described <br />in the attached Exhibit "A," is within said node, as contemplated <br />by the Land Use Element of the County's Comprehensive Plan, as <br />amended. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, that: <br />1. The foregoing recitals are affirmed in their <br />entirety; and <br />2. The 100 -acre more or less parcel presently owned by <br />D.S.C. Enterprises of Newark, Inc., and more particularly <br />described in the attached Exhibit "A," is hereby determined to lie <br />within the 175 -acre commercial/industrial node designated at the <br />intersection of I-95 and County Road 512, in accordance with the <br />Land Use Element of the Indian River County Comprehensive Plan. <br />The foregoing resolution was offered by Commissioner <br />Lyons who moved its adoption.
