(1) A person shall not reside within two thousand-five-hundred (2,500)-feet-of- <br /> the real prop g a public or nonpublic elementary or secondary- <br /> ... cc <br /> econdary. __ , e . e _ . - • — .•lid care facility. <br /> (2) A person who resides within two thousand five hundred (2,500) feet of the <br /> real property comprising a public or nonpublic elementary or secondary <br /> school, public park or licensed child care facility, commits a misdemeanor. <br /> (3) A person residing within two thousand five hundred (2,500) feet of the real <br /> property comprising a public or nonpublic elementary or secondary school, <br /> section if any of the following apply: <br /> a. The person is required to serve a sentence at a jail, prison, juvenile <br /> facility, or other correctional institution or facility. <br /> b. The person is subject to an order of commitment under F.S. Ch. 394. <br /> c. The person has established a residence prior to the February 7, <br /> 2006, or a school or child care facility is newly located on or after <br /> February 7, 2006. <br /> e. <br /> c. A state of emergency has been declared and the public or nonpublic <br /> • <br /> as an emergency shelter, the person shall notify the official in <br /> register their residence under Florida Law. If sufficient space <br /> permits, the persons may be kept in a separate room at the <br /> The following words, terms and phrases, when used in this article, shall have the <br /> meanings ascribed to them in this section and section 306.065, except where the context <br /> clearly indicates a different meaning: <br /> (1) Conviction means a determination of guilt which is the result of a trial or the entry of <br /> a plea of guilty or nolo contendere, regardless of whether adjudication is withheld. <br /> (2) Licensed childcare facility means any child care facility licensed by the state <br /> pursuant to F.S. Ch. 402. <br /> (3) Park means a publicly owned or operated area used or available for the public's use <br /> as a recreational facility, including, by way of example and not limitation, ball fields, <br /> 2 <br />
