37Z793 <br />RESOLUTION NO. 84-3 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, PROVIDING FOR THE CLOSING OF THE 4TH PLACE <br />FLORIDA EAST COAST RAILWAY COMPANY CROSSING. <br />WHEREAS, on December 28, 1983, the County received a duly <br />executed and documented petition from James W. Davis, P.E., <br />Public Works Director of Indian River County, Florida, <br />requesting the County to close the 4th Place Florida East Coast <br />Ra=ilway Company crossing. <br />WHEREAS, in accordance with Florida Statutes § <br />336.10, notice of a public hearing to consider sa;.d petition <br />has been duly published; and <br />WHEREAS, after consideration of the petition, <br />supporting documents, staff investir.�tion and report, and <br />testimony of all those interested and present, the Board finds <br />that said crossing is not a state or federal highway, nor <br />located within any municipality, nor _.s said crossing neceGgary <br />for continuity of the County's street and thoroughfare network, <br />nor access to any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. A parcel of land with uniform width of 70 <br />feet northerly and southerly, extending <br />easterly and westerly across the <br />right-of-way and main track of the RAILWAY <br />at Vero Beach, Florida, with the <br />longitudinal centerline of said parcel <br />being located 3,982 feet more or less <br />southerly from RAILWAY's Mile Post No. 229 <br />from Jacksonville, Florida, said <br />right-of-way of the RAILWAY having a total <br />width of 100 feet at this location, being <br />50 feet each side of the center line of the <br />RAILWAY's main track, <br />is hereby forever closed. <br />2. Notice of adoption of this resolution: shall <br />be forthwith published once within thirty (30) days from the <br />date of adoption hereof-; and <br />3. The Clerk is hereby directed to record this <br />resolution together with the proofs of publication ramu;rari r,y <br />Florida Statutes §336.10 in the Official Record Books of Indian <br />River County without undue delay. <br />The foregoing resolution was offered by <br />CommiSS4oner Bird who moved its adoption.
