i <br />6• <br />�.1 <br />RESOLUTION NO. 84-64 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF INDIAN RIVER <br />COUNTY, FLORIDA, PROVIDING FOR THE CLOSING OF THE 85TH STREET <br />ACCESS TO THE EAST SIDE OF U. S. HIGHWAY 01. <br />WHEREAS, on July 30, 1984, the County received a duly <br />executed and documented petition from Michael Orr, Traffic <br />Engineer of Indian River County, Florida, requesting the County <br />to close the 85th Street access to the east side of U.S. <br />Highway #1, <br />WHEREAS, the intent of this resolution is to close <br />physical access to 85th Street to alleviate a hazardous traffic <br />situation, rather than to abandon or re'_ease any easement or <br />right of ownership the County has in said right-of-way, <br />inasmuch as said right-of-way shall remain available for other <br />appropriate uses such as utilities or drainage improvements, <br />WHEREAS, in accordance with Florida Statutes § <br />336.10, notice of a public hearing to consider said petition <br />has been duly published; and <br />WHEREAS, after consideration of the petition, sup- <br />porting documents, staff investigation and report, and testimo- <br />ny of all those interested and present, the Board finds that <br />said access is not a state or federal highway, nor located <br />within any municipality, nor is said access necessary for <br />continuity of the County's street and thoroughfare network., nor <br />the sole access to any given private property. <br />NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. The physical access for the traveling public to <br />and from 85th Street at the U. S. Highway #1 intersection is <br />hereby closed, with the express understanding that the County <br />does not intend hereby to abandon or release any right or <br />easement of the County in and to the existing 85th Street <br />right-of-way. <br />2. Notice of adoption of this resolution shall be <br />forthwith published once within thirty (30) days from the date <br />of adoption hereof; and <br />'rte <br />3. The Clerk is hereby directed to record this <br />resolution together with the proofs of publication required by <br />Florida Statutes §336.10 in the Official Record Books of Indian <br />River County without undue delay. <br />' The foregoing resolution was offered by <br />`v <br />=e Commissioner Lyons who moved its adoption.
