40 <br />40 <br />of <br />569463 <br />RESOLUTION NO. 85- 14 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />' COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, ACCEPTING AS A PUBLIC ROAD A <br />PORTION OF 33RD AVENUE AND 15TH STREET, <br />LOCATED IN TERILIL TERRACE SUBDIVISION <br />IN THE CITY OF VERO BEACH. <br />WHEREAS, by plat filed for record on June 26, 1978, and <br />recorded on Page 94 of Plat Book 9, in the Office of the Clerk of <br />the Circuit Court of Indian River County, the subdivider platted <br />certain streets and easements in a subdivision within the city <br />limits of the City of Vero Beach with "full knowledge that the same <br />are not dedicated to the public until there is a formal acceptance <br />of these street and/or easements, or any part thereof, by the <br />County (e.s.)," and <br />WHEREAS, there is some question t.s to whether the County <br />has ever formally accepted these streets or easements, and <br />WHEREAS, the City of Vero Beach desires that 33rd Avenue <br />and 15th Street in the subdivision be public streets under the <br />control of the municipality; <br />NOW, TIIEREFORE, BE IT RESOLVED BY THE BOARD OF <br />COUNTY COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA, <br />that: <br />1. The streets and easements shown on the plat of <br />Terilil Terrace Subdivision, including the northerly 60 -foot right <br />of way dedicated for future road purposes, are accepted by the <br />County as public streets and easements dedicated to the public. <br />2. By this acceptance, it is the intention of the Board <br />of County Commissioners that the streets and easements, as shown on <br />the plat, will be considered municipal streets and easements, and <br />that the County shall have no obligation for maintenance and no <br />other liability whatsoever concerning these streets. <br />The foregoing resolution was offered by Commissioner who <br />Wodtke moved its adoption. The motion was seconded by <br />Commissioner Bowman and, being put to a vote, the vote <br />was as follows: <br />Chairman Patrick B. Lyons Aye <br />Vice Chairman Don C.
