•o <br />RESOLUTION NO. 85- 19 <br />WHEREAS, Carl D. Klickman, Sam W. Klein and Belle M. <br />Deitch, are co-owners of a large tract of property adjoining <br />Lindsey Road, an unpaved road in Indian River County; and <br />WHEREAS, the Indian River County Board of County <br />Commissioners intends to construct paving and drainage <br />improvements on Lindsey Road in order to relieve traffic <br />congestion along several east/west traffic arteries and to <br />otherwise serve the best interests of the ci,A tens of Indian River <br />County; and <br />WHEREAS, Carl D. Klickman, Sam W. Klein and Belle M. <br />Deitch have agreed, subject to the conditions contained herein, to <br />donate to Indian River County a large parcel of land necessary to <br />create the proper right-of-way within which the necessary paving <br />and drainage improvements to Lindsey Road may be constructed; and <br />WHEREAS, the Board of County Commissioners of Indian <br />River County, on behalf of all the citizens of Indian River County <br />wishes to thank Carl D. Klickman, Sam W. Klein and Belle M. Deitch <br />for their donation to Indian River County. <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA that: <br />1. Indian River County hereby accepts the donation and <br />dedication of land for the Lindsey Road right-of-way .from Carl D. <br />Klickman, Sam W. Klein and Belle M. Deitch, said land being more <br />fully described in attachment "A" hereto; and <br />2. That the land herein described may be included in <br />the acreage calculations for the purposes of density determination <br />when the parcel from which the land was dedicated is proposed for <br />development, pursuant to Indian River County Code of Laws and <br />Ordinances, Appendix A, Zoning, Section 25(t); and <br />3. That the County will not assess any of the costs of <br />the pavement and drainage improvements to Lindsey Road against <br />Carl D. Klic)unan, Sam W. Klein and Belle M. Deitch; and <br />4. That, if the construction of paving and drainage <br />improvements to Lindsey Road are not begun within three years from <br />the date hereinafter set forth, that ownership of the property <br />-1- <br />
