RESOLUTION NO. 85- 59 <br />A RESOLUTION OF THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, <br />FLORIDA, PROVIDING FOR CERTAIN PAVING <br />® AND DRAINAGE IMPROVEMENTS TO APPLE 11AY <br />FROM 12TH STREET SOUTH APPROXIMATELY <br />1125 L.F.; PROVIDING THE TOTAL ESTDIATED <br />COST, ME'T'HOD OF PAYMENT OF ASSESSMENTS, <br />NUMBER OF ANNUAL INSTALLI'MS, AND <br />LEGAL DESCRIPTION OF THE AREA SPECIALLY <br />B 4W' ITEA. <br />• ® WHEREAS, the County Public Works Department has received <br />a request for improvements signed by all of the owners of property in <br />the area to be specially benefited, requesting paving and drainage <br />improvements to Apple Way from 12th Street, runnjng south approximately <br />1125 lineal feet; and <br />WHEREAS, the Board of County Camnissioners has considered <br />this request and has determined that it is appropriate for the County to <br />undertake the requested improvements and assess one -hundred percent of <br />the cost thereof to the owners of properties specially benefited, <br />pursuant to authority contained in Ordinance 81-27, and <br />WHEREAS, the Public Works Division has cxmpleted <br />preliminary design work including a cost estimate which indicates the <br />actual total estimated cost of the proposed improvements to be <br />$19,696.25; and <br />WHEREAS, the special assessment provided hereunder shall, <br />for any given record owner of property within the area specially bene- <br />fited, be in an amount equal to 1/8 (12�%) of the actual cost of the <br />project, and shall became due and payable at the office of. the Tax <br />Collector of Indian River County ninety days after the final determi- <br />nation and of the special assessment pursuant to Ordinance 81-27; and <br />and <br />WHEREAS, any special assessment not paid within said ninety <br />(90) day period shall bear interest beyond the due date at a rate <br />established by the Board of County ccrmdssioners at the time of <br />preparation of the final assessment roll, and shall be payable in two <br />(2) equal installments, the first to be made twelve (12) months from the <br />due date and the second to be made twenty-four(24) months fmn the due <br />date; and <br />WHEREAS, after examination of the nature and anticipated <br />usage of the proposed improvements, the Board of County Commissioners <br />has determined that the following described properties shall receive a <br />direct and special benefit fran these improvements, to wit: <br />Lots 1 through 8, Apple Way Subdivision as <br />recorded in the public records of Indian <br />River County in Plat Book 9 Page 2 said <br />land now lying and being in Indian River <br />County, Florida. <br />
