RESOLUTION NO. 85-61 <br />711 <br />RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF <br />S INDIAN RIVER COUNTY, FLORIDA, TRANSFERRING AND <br />AMENDING RESOLUTION NO. 80-88, A WATER AND SEWER <br />FRANCHISE FOR VILLAGE GREEN, PHASE IV (WEST), FROM <br />FLORIDA -ATLANTIC ASSOCIATES, A NEW YORK GENERAL <br />PARTNERSHIP TO REALCOR-VERO BEACH ASSOCIATES, A <br />FLORIDA GENERAL PARTNERSHIP <br />BE IT RESOLVED by the Board of County Commissioners of Indian River <br />County, Florida; <br />WHEREAS, Indian River County previously granted Florida -Atlantic <br />Associates a water and sewer franchise pursuant to Resolution No. 80-88 to <br />serve Village Green Phase IV, and <br />WHEREAS, Florida -Atlantic Associates now desires to transfer the <br />franchise to the purchaser of Village Green Phase IV (West), Realcor-Vero <br />Beach Associates, a Florida General Partnership, contingent upon buyer <br />closing the transaction. <br />NOW, THEREFORE, Resolution No. 80-88 is hereby amended to read: <br />SECTION I <br />This Resolution shall be known and may be cited as the VILLAGE GREEN <br />PHASE IV (WEST) WATER AND WASTEWATER SYSTEM FRANCHISE. <br />SECTION II <br />DEFINITIONS <br />For the purpose of this Resolution, the following terms, phrases, <br />words and their derivations shall have the meaning given herein. When not <br />inconsistent with the context, words using the present tense include the <br />future, words in the plural number include the singular and vice versa. <br />The word "shall" is always mandatory. <br />(a) "County" is Indian River County Utility Services Department, a <br />political subdivision of the State of Florida. <br />(b) "County Engineer" may be "County Administrator or County Utilities <br />Director". <br />(c) "Utility" is the Grantee of rights under this franchise, to wit: <br />REALCOR-VERO BEACH ASSOCIATES, A Florida General Partnership. <br />(d) "Board" is the Board of County Commissioners. <br />
