repairs using said funds in the event of default on the part of the Utility <br />40 in maintaining the quality standards established herein. In the event that <br />the County purchases the corporation's utility system pursuant to the <br />provisions of this franchise as stated above, then any funds in said <br />• renewal and replacement account shall vest in the County. <br />•• <br />OVOMTnM YVTT <br />INSURANCE <br />1. The Utility shall at all times maintain public liability and <br />property damage insurance in such amounts as set forth in, to wit: <br />Exhibit "B" attached hereto and incorporated herein. <br />2. The Utility shall cause the County to be :uly notified by the <br />insurer in the event of any modifications or deletions of the insurance as <br />set forth in said Exhibit "B". Said amounts shall be adjusted by the <br />Utility, as shall be required from time to time by the Board in accordance <br />with good business practices as determined by safe business standards as <br />established by the Board for the protection of the County and the ,general <br />public and for any liability which may result from any action of the <br />Utility. <br />3. Said insurance shall co -name Indian River County as an additional <br />isured. <br />4. Certificate of insurance shall be filed with the County annually. <br />--nil VVTTT <br />CONSUMER COMPLAINTS <br />If any written complaint is filed with the Board by any persons <br />serviced by the Utility under this franchise, the Board shall first <br />determine whether reasonable cause exists with respect to said complaint. <br />If the Board finds reasonable cause does exist, the Board shall so notify <br />the Utility and request the Utility to satisfy or remedy such complaint. <br />If the Utility fails, within a reasonable time, to satisfy or remedy such <br />complaint or objection, the Board may review same according to the <br />provisions hereof. If the Board enters its order pursuant to such hearing <br />and the Utility feels it is aggrieved by such order, the Utility may seek <br />review of the Board's action by petition for Writ of Certiorari filed in <br />the Circuit Court of the County; otherwise the Utility shall promptly <br />comply with the order of the Board. <br />SECTION XIX <br />CHANGE 1N RATE SCHEDULE <br />1. Should the Utility desire to establish rates and charges or <br />should the Utility desire to increase any charges heretofore established <br />and approved by the Board, then the Utility shall notify the Board in <br />writing, setting forth the schedule of rates and charges which it proposes. <br />
