RESOLUTION NO. 85- 124 <br />A RESOLUTION TO CLARIFY THE ADVISORY ROLE OF CERTAIN <br />COMMITTEES AND BOARDS CREATED BY THE INDIAN RIVER <br />COUNTY BOARD OF COUNTx COMMISSIONERS. <br />WHEREAS, in accordance with Chapter 112, Florida <br />Statutes, certain local board or committee members are required to <br />file financial disclosure; <br />WHEREAS, an "Advisory Body" is exempt from the <br />disclosure law if its total budget, appropriations, or authorized <br />expenditures constitutes less than one percent of the budget of <br />the agency it serves or $100,000.00, whichever is less, and its <br />powers, jurisdiction, and authority are solely advisory and do not <br />i <br />include the final determination or a judication of any personal or <br />property rights, duties, or obligations; <br />S <br />WHEREAS certain committees or boards created by the <br />G <br />Board of County Commissioners of Indian River County Commissioners <br />of )ndian River County constitute "advisory bodies" within the <br />meaning of the law in function and in practice, but not in the <br />specific wording of their enabling motion or resolution; and <br />WHEREAS according to the State of Florida Commission <br />on Ethics it is desirable to pare down listed persons required to <br />file financial disclosure by clarifying the function of advisory <br />bodies; <br />BE IT THEREFORE RESOLVED THAT THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, FLORIDA DOES HEREBY DECLARE <br />AND CLARIFY that the following Indian River County boards, <br />bodies, or committees are in function and in practice "advisory <br />bodies" exempt from the disclosure law: <br />Beach Preservation and Restoration Committee <br />Marine Island Advisory Commission <br />Occupational License Study Committee <br />Parks and Recreation Committee <br />Sea Grass Preservation Committee <br />Scenic Roads and Trails Committee <br />The foregoing resolution was offered by Commissioner <br />Scurlock who moved its adoption. The motion was seconded <br />by Commissioner Wodtke and, upon being put to a vote, the <br />vote was as follows: <br />Chairman Patrick B. Lyons Aye <br />vice -Chairman Don C.
