ONE-YEAR EXTENSION OF MEMORANDUM OF UNDERSTANDING for Coordination of Supplemental Beach Nourishment and Related Coastal Activities THIS ONE-YEAR EXTENSION OF MEMORANDUM OF UNDERSTANDING for COORDINATION OF SUPPLEMENTAL DOWNDRIFT NOURISHMENT AND RELATED COASTAL ACTIVITIES ("Extension") entered into effective this day of April 2023 ("Effective Date") by and between INDIAN RIVER COUNTY, a political subdivision of the State of Florida ("County"); and the Sebastian Inlet District ("District") an independent special taxing district established by a Special Act of the Florida Legislature, and agree as follows: WHEREAS, on April 2, 2013, the County and the District entered into a Memorandum of Understanding for Coordination of Supplemental Beach Nourishment and Related Coastal Activities (Agreement); and WHEREAS, the Agreement called for an initial term of five (5) years subject to renewal for an additional five (5) year term, for a total of ten (10) years; and WHEREAS, on April 2, 2019, the County and the District renewed and extended the Agreement until April 1, 2023; and WHEREAS, the District has convened a Technical Advisory Committee (TAC), in which the County is an active participant, to update the Sebastian Inlet Management Plan, expected completion 2024; and WHEREAS, the Parties have mutually benefitted from participating in the Agreement and desire to extend the Agreement for a one-year term while the TAC is ongoing; NOW THEREFORE, in consideration of the premises and other good and valuable consideration, the receipt whereof is hereby acknowledged, the parties agree as follows: 1. The above recitals are true and correct and are adopted by reference herein. 2. The term of the Memorandum of Understanding for Coordination of Supplemental Beach Nourishment and Related Coastal Activities dated April 2, 2013 and renewed April 2, 2019 is hereby extended until April 1, 2024. 3. The remaining terms and conditions of the Agreement shall remain unchanged. 1 140
