ONE-YEAR EXTENSION OF MEMORANDUM OF UNDERSTANDING <br />for <br />Coordination of Supplemental Beach Nourishment and Related Coastal Activities <br />THIS ONE-YEAR EXTENSION OF MEMORANDUM OF UNDERSTANDING for <br />COORDINATION OF SUPPLEMENTAL DOWNDRIFT NOURISHMENT AND RELATED <br />COASTAL ACTIVITIES ("Extension") entered into effective this day of April 2023 <br />("Effective Date") by and between INDIAN RIVER COUNTY, a political subdivision of the <br />State of Florida ("County"); and the Sebastian Inlet District ("District") an independent <br />special taxing district established by a Special Act of the Florida Legislature, and agree <br />as follows: <br />WHEREAS, on April 2, 2013, the County and the District entered into a <br />Memorandum of Understanding for Coordination of Supplemental Beach Nourishment <br />and Related Coastal Activities (Agreement); and <br />WHEREAS, the Agreement called for an initial term of five (5) years subject to <br />renewal for an additional five (5) year term, for a total of ten (10) years; and <br />WHEREAS, on April 2, 2019, the County and the District renewed and extended <br />the Agreement until April 1, 2023; and <br />WHEREAS, the District has convened a Technical Advisory Committee (TAC), in <br />which the County is an active participant, to update the Sebastian Inlet Management Plan, <br />expected completion 2024; and <br />WHEREAS, the Parties have mutually benefitted from participating in the <br />Agreement and desire to extend the Agreement for a one-year term while the TAC is <br />ongoing; <br />NOW THEREFORE, in consideration of the premises and other good and <br />valuable consideration, the receipt whereof is hereby acknowledged, the parties agree as <br />follows: <br />1. The above recitals are true and correct and are adopted by reference herein. <br />2. The term of the Memorandum of Understanding for Coordination of <br />Supplemental Beach Nourishment and Related Coastal Activities dated April <br />2, 2013 and renewed April 2, 2019 is hereby extended until April 1, 2024. <br />3. The remaining terms and conditions of the Agreement shall remain unchanged. <br />1 <br />140 <br />
