associated documentation, and other material, as applicable, for review by the SWIC to ensure coordination. <br />Recipients must provide a listing of all communications equipment purchased with award funding (plus the quantity <br />purchased of each item) to FDLE once items are procured during any periodic programmatic progress reports. <br />16.0 Global Standards Package - In order to promote information sharing and enable interoperability among disparate <br />systems across the justice and public safety community, OJP requires the recipient to comply with DOJ's Global <br />Justice Information Sharing Initiative (DOJ's Global) guidelines and recommendations for this particular award. <br />Recipient shall conform to the Global Standards Package (GSP) and all constituent elements, where applicable, as <br />described at https:Hit.oig.gov/qsp. Recipient shall document planned approaches to information sharing and describe <br />compliance to the GSP and appropriate privacy policy that protects shared information, or provide detailed <br />justification for why an alternative approach is recommended. <br />17.0 Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment — In accordance <br />with the requirements as set out in 2 C.F.R. § 200.216, recipients are prohibited from obligating or expending award <br />funds to: <br />1) Procure or obtain; <br />2) Extend or renew a contract to procure or obtain; <br />3) Enter into a contract to procure or obtain equipment, services, or systems that use telecommunications <br />equipment or services as a substantial or essential component of any system, or as critical technology as part <br />of any system, produced by Huawei Technologies Company or ZTE Corporation (or a subsidiary or affiliate of <br />such entities). <br />18.0 Unreasonable Restrictions on Competition -This condition applies with respect to any procurement of property <br />or services funded (in whole or in part) by this award, by the recipient (or subrecipient at any tier), and regardless of <br />the dollar amount of the purchase or acquisition, the method of procurement, or the nature of any legal instrument <br />used. The provisions of this condition must be among those included in any subaward (at any tier). <br />1) Consistent with the (DOJ) Part 200 Uniform Requirements -- including as set out at 2 C.F.R. 200.300 and <br />200.319(a) — Recipient (or subrecipient at any tier) may (in any procurement transaction) discriminate against <br />any person or entity on the basis of such person or entity's status as an "associate of the federal government" <br />(or on the basis of such person or entity's status as a parent, affiliate, or subsidiary of such an associate), except <br />as expressly set out in 2 C.F.R. 200.319(a) or as specifically authorized by USDOJ. <br />2) Monitoring of compliance with the requirements of this condition will be conducted by FDLE. <br />3) The term "associate of the federal government" means any person or entity engaged or employed (in the past <br />or at present) by or on behalf of the federal government -- as an employee, contractor or subcontractor (at any <br />tier), award recipient or -subrecipient (at any tier), agent, or otherwise -- in undertaking any work, project, or <br />activity for or on behalf of (or in providing goods or services to or on behalf of) the federal government, and <br />includes any applicant for such employment or engagement, and any person or entity committed by legal <br />instrument to undertake any such work, project, or activity (or to provide such goods or services) in future. <br />4) Nothing in this condition shall be understood to authorize or require any recipient, any subrecipient at any tier, <br />or any person or other entity, to violate any federal law, including any applicable civil rights or nondiscrimination <br />law. <br />19.0 Non -Disclosure Agreements - No recipient or entity that receives a procurement contract or subcontract with any <br />funds under this award, may require any employee or contractor to sign an internal confidentiality agreement or <br />statement that prohibits or otherwise restricts, or purports to prohibit or restrict, the reporting of waste, fraud, or abuse <br />to an investigative or law enforcement representative of a federal department or agency authorized to receive such <br />information. <br />20.0 Confidential Funds and Confidential Funds Certificate - A signed certification that the Project Director or <br />Implementing Agency Chief Official has read, understands, and agrees to abide by all conditions for confidential <br />funds outlined in Section 3.12 of the DOJ Grants Financial Guide is required for all projects that involve confidential <br />funds. The signed certification must be submitted at the time of award application. Confidential Funds certifications <br />must be signed by the recipient Chief Official or an individual with formal, written signature authority for the Chief <br />Official. <br />Prior to the reimbursement of expenditures for confidential funds, the recipient must compile and maintain a Cl Funds <br />Tracking Sheet to record all disbursements under the award. The completed form must be submitted with the <br />payment request for OCJG review. <br />21.0 For JAG: Task Force Training Requirement - The recipient agrees that within 120 days of award, each current <br />member of a law enforcement task force funded with these funds who is a task force commander, agency executive, <br />Page 22 of 26 <br />
