Titkanich, County Administrator <br />Kristin Daniels, Budget Director <br />FROM: Jennifer Hyde, Purchasing Manager <br />SUBJECT: Third Amendment to Agreement for Annual Lift Station <br />Rehabilitation (Bid 2019047) <br />BACKGROUND: <br />The Board of County Commissioners awarded bid 2019047 to Hinterland Group, Inc., on <br />June 4, 2019, for as needed rehabilitation of lift stations and other appurtenances at <br />wastewater facilities. On September 17, 2019, the first amendment to the agreement was <br />approved, appending the items of work, and the first renewal and second amendment was <br />approved by the Board on May 17, 2022. The term of the first renewal is through June 3, <br />2024, with no additional renewals available. <br />DISCUSSION: <br />The agreement, incorporating the invitation to bid by reference, requires the contractor to <br />provide a public construction bond for each work order over $1oo,000. Hinterland has <br />provided bonds, as required, however staff has determined the requirement for bonds to be <br />unnecessary. <br />Because the contractor is not paid until each project is completed in full, there is no risk of <br />loss to the County that would require a bond. Bonding adds cost, and time delay to the <br />overall projects. Therefore, staff would like to remove the requirement for public <br />construction bonds. <br />SOURCE OF FUNDS: <br />Funds are available in the Utilities/WW Collection/Lift Station Rehabs account <br />(47126836-044699-19512) in the operating fund. Operating funds and are generated from <br />water and sewer revenues.
