The Chairman opened the public hearing and asked if anyone <br />wished to be heard in this matter. There being none, she closed <br />the public hearing. <br />ON MOTION by Commissioner Eggert, SECONDED by <br />Commissioner Tippin, the Board unanimously adopted <br />Ordinance 96-12 codifying the ordinances of Indian <br />River County, Florida. <br />ORDINANCE 96- 12 <br />AN ORDINANCE OF INDIAN RIVER COUNTY, <br />FLORIDA, CODIFYING THE ORDINANCES OF <br />INDIAN RIVER COUNTY, FLORIDA. <br />WHEREAS, Section 125.68, F.S. requires the current codification <br />of all ordinances comprising the code; and <br />WHEREAS, this is to be done on an annual basis, <br />NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY <br />COMMISSIONERS OF INDIAN RIVER COUNTY, that: <br />SECTION 1. CODIFICATION. <br />All ordinances <br />which have been <br />published in <br />"The <br />..Code of <br />Indian <br />River County" up <br />to and including <br />Supplement <br />No. <br />23 are <br />hereby <br />deemed to be codified and said code shall be the best evidence of the <br />laws of Indian River County. <br />SECTION 2. SEVERABILITY. <br />If any section, or any sentence, paragraph, phrase, or word of <br />this ordinance is for any reason held to be unconstitutional, <br />inoperative, or void, such holding shall not affect the remaining <br />portions of this ordinance, and it shall be construed to have been the <br />legislative intent to . pass the ordinance without such., unconstitutional, <br />invalid or inoperative part. <br />SECTION 3. EFFECTIVE DATE. <br />A certified <br />copy of this <br />ordinance, as <br />enacted, <br />shall <br />be <br />filed <br />by <br />the Clerk with <br />the Office of <br />the Secretary <br />of State <br />of <br />the <br />state <br />of <br />Florida within ten days after enactment, and this ordinance shall take <br />effect upon filing with the Secretary of State. <br />JUNE 49 1996 31 eooK 98 i�Au 277 <br />
