2. Appoint a CR 512 task force within a timeframe such that the <br />CR 512 corridor planning process can begin when the SR 60 <br />corridor plan process is completed, and <br />a. Invoke the pending ordinance doctrine now, after citing <br />specifically what pending regulations are to be applied <br />and the circumstances to which they are to be applied; or <br />b. Invoke the pending ordinance doctrine at such time as the <br />Board considers the task force's recommended plan and <br />adopts a CR 512 Corridor Plan. <br />As previously stated, it is planning staff's opinion that the <br />county should focus on and complete its work on the SR 60 Corridor <br />Plan before starting a CR 512 corridor plan process. Therefore, it <br />is planning staff's recommendation that neither option l.a. nor <br />option l.b. be selected. Also, as previously referenced, the <br />county attorney's office has given an opinion that the pending <br />ordinance doctrine cannot be legally invoked for CR 512 until the <br />Board has approved a CR 512 corridor plan. Therefore, neither <br />option l.a. nor 2.a. should be selected. Thus, the option <br />consistent with both the planning staff and attorney's office <br />opinions is option 2.b. Under such an option, planning staff would <br />continue to recommend design enhancements to developers of new non- <br />residential projects along CR 512, as referenced in attachment #2. <br />RECOMMENDATION: <br />Staff recommends that the Board of County Commissioners: <br />1. Agree to appoint a task force to prepare a corridor plan for <br />CR 512. <br />2. Direct planning staff to return to the Board with a <br />recommended list of potential task force members in a timely <br />manner that will allow the CR 512 task force to begin its work <br />as soon as the Board considers the recommendations of the SR <br />60 Corridor Plan Task Force. <br />3. Direct staff to continue to encourage developers of new non- <br />residential projects along CR 512 to incorporate into their <br />development plans the design principles of the Wabasso <br />Corridor Plan. <br />Commissioner Macht felt the County must do the best it can to <br />assure development does not become ugly and does not adversely <br />impact residents who live close to the thoroughfare. <br />Deputy County Attorney Collins expressed his concerns <br />regarding ordinances being applied in different parts of the County <br />which are unwritten and not yet formally adopted. He felt a task <br />force could apply other criteria which are not yet in ordinance <br />form which would allow landowners to proceed under laws as they are <br />now, not as they may be sometime in the future. <br />Commissioner Bird felt this task force may be a little <br />premature. <br />Chairman Adams cited the Vero Lake Estates community which <br />made an effort to clean up their community and commended staff who <br />made an effort to go ahead and start the process.
