SUPPLEMENTARY CONDITIONS TO GENERAL CONDITIONS <br />A. Irrrnmfuc io <br />These Supplementary Conditions amend or supplement the General Conditions (GC) of <br />the Construction Contract and other provisions of the Contract Documents as indicated <br />below. All provisions which are riot so amended or supplemented remain in full force and <br />effect. <br />B. Do a+, <br />No forfeiture due to delay shall be made because of any delays in the wompletion <br />of the work due to unforeseeable causes beyond the control and without the fault <br />or negligence of the CONTRACTOR (including but not restricted to Acts of God or <br />of the public enemy, acts of the government, acts of the OWNER, or acts of <br />another CONTRACTOR in the performance of a contract with the OWNER, fires, <br />floods, epidemics, quarantine restrictions, strikes, freight embargoes and unusually <br />severe weather or delays of subcontractors due to such causes or delays caused <br />by the failure of the OWNER or the owner of a utility to provide for removal or <br />relocation of existing utility facilities). Any such delays shall not Entitle the <br />CONTRACTOR to any additional compensation. The sole remedy of the <br />CONTRACTOR shall be an extension of time obtained in accordance with this <br />section. <br />2. The CONTRACTOR shall, within five days from the beginning of any such delay, <br />notify the OWNER in writing of the cause of delay, whereupon the OWNER shall <br />ascertain the facts and extent of the delay and extend the time for completinq the <br />work if, in his judgment, the findings of fact justify such an extension, and his <br />findings of facts thereon shall be final and conclusive. <br />C.er njis <br />`l. As set forth in paragraph 61.15 of the GC, the OWNE=R has obtained the following <br />pen -nits: <br />a. FDOT Maintenance Memorandum of Agreement <br />2. The CONTRACTOR shall be familiar with all permit requirements during <br />construction and shall be responsible for complying with these requirements. The <br />cost of this effort shall be included in the pay item which the work is most closely <br />associated with. <br />d. if dewatering is required, the CONTRACTOR shall coordinate with the St. Johns <br />Rawer Water Management District regarding the applicable rules and regulations. <br />If a dewatering permit is required, the contractor shall prepare an application to the <br />District and pay any fee. <br />SUPPLEMENTARY CONDITIONS <br />
