0 <br />ME <br />ALt�Of�IE ' RSF'ONSI3 I.I <br />8.1 OWNER shall issue all communications to CONTRACTOR through ENGINEER. <br />8.2 In case of termination of the employment of ENGINEER, OWNER shall appoint an <br />engineer against whom CONTRACTOR makes no reasonable objection, whose status <br />under the Contract Documents shall be that of the former ENGINEER. Any dispute in <br />connection with such appointment shall be subject to arbitration. <br />8.3 OWNER shall furnish the data required of OWNER under the Contract Documents <br />promptly and shall make payments to CONTRACTOR promptly after they are due as <br />provided in paragraphs 14.4 and 14.13. <br />8.4 OWNER's duties in respect of providing lands and easements and providing engineering <br />surveys to establish reference points are set forth in paragraphs 4.1 and 4.1 u. Paragraph <br />4.2 refers to OWNER's identifying and making available to CONTRACTOR copies of <br />reports of explorations and tests of subsurface conditions at the site and in existing <br />structures which have been utilized by ENGINEER In preparing the Drawings and <br />Specifications. <br />8.5 OWNER is obligated to execute Change Orders as indicated in paragraph 10.4, <br />8,6 OWNER's responsibility in respect of certain inspections, tests and approvals is set forth <br />in paragraph 13.4. <br />8.7 In connection with OWNER's right to stop Work or suspend Work, see paragraphs 13, 10, <br />and 15. 1, Paragraph 15.2 deals with OWNER's right to terminate services Of <br />CONTRACTOR under certain circumstances. <br />ARTirt E g - ENCINEER [TURING STRUCTIUM <br />OWNER's Representative: <br />9.1 ENGINEER will be OWNER's representative during the construction period. The duties <br />and responsibilities and the limitations of authority of ENGINEER as OWNER's <br />representative during construction are set forth in the Contract Documents and shall not <br />be extended without written consent of OWNER and ENGINEER. <br />Visits to Site: <br />,. a a4 6. z �qul� z rnnreo4� 4n tho uwrini:c Onnac ni <br />9.2 ENGINEER will riiakv- Visits ',u t is Si, <br />as ii ir.t.� ..f„I;„ �F..^- --��- <br />construction to observe the progress and quality of the executed Work and to determine, <br />in general, if the Work is proceeding in accordance with the Contract Documents. <br />ENGINEER will not be required to make exhaustive or continuous onsite inspecticns to <br />check the quality or quantity of the Work. ENGINEEI;'s efforts will be directed toward <br />providing for OWNER a greater degree of confidence that the completed Work will <br />conform to the Contract Documents. On the basis of such visits and on-site observations <br />as an experienced and qualified design professional, ENGINEER will keep OWNER <br />informed of the progress of the Work and will endeavor to guard OWNER against defects <br />and deficiencies in the Work. <br />GENERAL CONDITIONS <br />
