1W N-01 <br />W-10 <br />b. no activities shall be conducted, within the WETLANDS as <br />i <br />delineated on the map attached hereto and marked Exhibit B or other <br />naturally vegetated areas, which damage fish or wildlife, or their habitats, or <br />40 <br />which alter natural drainage or floodplains or result in erosion, siltation or <br />other forms of water pollution; <br />C. recreational activities planned or, conducted within WETLANDS <br />and other naturally vegetated areas shall be resource-based ( i.e. , dependent <br />a <br />on existing elements of the natural environment) and the development of <br />recreational facilities within the WETLANDS shall be restricted to trails, <br />boardwalks, or other alterations which facilitate access For the passive/non <br />consumptive recreational user; <br />d, the DISTRICT may engage In construction or other activities <br />necessary for water management purposes provided that such construction al- <br />ractivities <br />activitiesare described within the approved management plan, <br />e. the COUNTY may develop user -oriented recreational facilities <br />(i.e., those not dependent on existing elements of the natural environment) <br />on portions of the PROPERTY outside the WETLANDS provided that the water <br />resource values of the affected land existing prior to development are not <br />diminished, <br />f. nothing contained in this AGREEMENT shall be construed as a <br />waiver of or contract with respect to the regulatory or' permitting authority of <br />the DISTRICT as it now or hereafter exists under applicable laws, rules and <br />regulations. <br />3. The DISTRICT and the COUNTY shall, within one (1) year from the <br />effective date of this Agreement, jointly develop a mutually acceptable <br />management plan for the PROPERTY. Any and all improvements or permanent <br />alterations to the PROPERTY must be described within a plan approved by <br />both parties to • this AGREEMENT prior to their implementation. The <br />DIS'T'RICT shall assume primary responsibility for drafting the plan as It <br />relates to the manipulation of the natural vegetative communities and the area <br />within the WETLANDS. The COUNTY shall assume primary responsibility for <br />drafting the plan as it relates to the areas OUTSIDE the WETLANDS and the <br />development and operation of any recreational and educational facilities. An <br />amendment to the plan may be proposed by either party to this AGREEMENT <br />W-10 <br />
