i <br />40 <br />NOW THEREFORE, the parties hereto commit, through this Memorandum of <br />Agreement, to conduct themselves in accordance with the attachment hereto. Specifically, the <br />Commission agrees that the Board of County Commissioners of Indian giver County, Florida, <br />and its agents and employees, will cooperate with the Department in accordance with the <br />attached protocols for issuance of emergency protection permits, and the additional requirements <br />for the protection of marine turtles and their habitat. The Florida Department of Environmental <br />Protection agrees that favorable recommendations as to issuance of Departmental permits will be <br />given to those applicants that have conducted their activities in accordance with the <br />authorizations issued by Indian River County and that meet all applicable requirements of law. <br />The parties agree that this Memorandum of Agreement will remain in effect until a Habitat <br />Conservation Plan addressing the issues contained herein incorporates or supersedes this <br />Memorandum of Agreement. <br />FNTERED INTO this f 5 rday of ! , 1999. <br />Attest: J.
