• <br />+• <br />ADDENDUM NO.2 TO CONTRACT IrUR SALE A PURCHASE <br />Seller's property drains through discharge points located at the northeast corner of the <br />property, the southeast comer of the property, and the southwest comer of the property. <br />These discharge points empty drainage ditches on Seller's property by releasing the ditches' <br />contents into the Main Relief Canal, generally located adjacent to and immediately Bast of <br />58' Avenue (King's Highway) and a second canal generally located immediately South and <br />adjacent to 1211 Street. The drainage pipes are approximately AI inches AC) in <br />diameter. <br />The property being sold to Buyer includes or may affect both the drainage ditches and the <br />discharge pipes referenced above. The purchase price paid by Seller includes compensation <br />to replace the drainage ditches so that Seller's property continues to drain as it did prior to <br />the sale. Buyer represents and warrants that any and all modifications to the subject <br />property by Buyer shall not adversely affect or in any way burden the drainage of Seller's <br />property and the property's continued ability to drain through the discharge pipes described <br />above,. Should the discharge pipes be modified, improved, or otherwise made a part of <br />Buyer's work, then Buyer agrees, at its sole expense, to replace said discharge pipes with <br />pipes of an equal diameter and capacity as those which presently exist. The obligations set <br />forth in this paragraph shall survive closing, <br />2. A portion of the property being sold to Buyer (generally described as the North 50 feet of the <br />South 80 feet of Seller's East 19.8 acres of Tract 8) includes ornamental plants and palm <br />trees. Seller, without obligation to do so, may remove so many of tile palm trees, ornamental <br />,plants and grass as they desire without affecting the terms of this Contract. `1'hc parties agree <br />this provision is of no consequence to Buyer as a result of Buyer's intention to make <br />improvements to the subject properly consisting of a road and road right-of-way. <br />BVER: <br />4ennoth R.
