AND <br />INDIAN RIVER COUN I`Y, FLORIDA. <br />This is an amendment to the existing Construction Testing Services Agreement (AGREEMENT) <br />dated February 3, 1993, between Dunkelberger Engineering and Testing, Inc. (ENGINEER) and <br />Indian River County (COUNTY). This amendment addresses changes in "Section IV - <br />Compensation" of the AGREEMENT'. <br />This amendment includes the following: <br />"Section IV - Compensation" is being adjusted to increase the Not -to -Exceed amount of the <br />AGREEMENT. <br />The section of the original AGREEMENT entitled "Section IV - Compensation" shall be revised to <br />include compensation on a unit price basis for actual testing provided tip to a total "Not -to -Exceed" <br />budget of $152,000.00. <br />The AGREEMENT is hereby amended as specifically set forth herein. All other sections of the <br />AGREEMENT shall remain in full force and effect, and are incorporated herein. <br />This Amendment No. 1 to the AGREEMENT, regardless of where executed, shall be governed by <br />and construed by the laws of the State of Florida. <br />In witness whereof the parties have executed this amendment this day of <br />1999.---Z9- -- <br />Dunkelberger Engineering and Testing, Inc. <br />523A N.W.
